Jurisdiction; Choice of Law and Forum
This Site is operated by First Class Travel Waco in the United States and First Class Travel Waco makes no warranty that the materials and content on the Site are appropriate or available for use outside the United States. Those who choose to access the Site from outside the United States do so on their own initiative and are responsible for local laws, if and to the extent that local laws are applicable. Any cause of action you may have hereunder or with respect to your use of the Site must be commenced by filing suit in Dallas County, Texas, within one (1) year after the incident upon which the claim or cause of action is based first occurred. By using the Site, you irrevocably consent that any cause of action you may submit in connection with your use of the Site or pursuant to these Terms will be filed in the state or federal courts in Dallas County, Texas, which you acknowledge, consent, and agree will be the exclusive forum and venue for any legal dispute between you and us. You also agree that any dispute between you and us will be governed by the laws of the State of Texas, without regard to conflict of laws principles.

Passenger Policies and Regulations
First Class Travel Waco does not have vehicles with wheelchair accessibility ramps or lifts. However, if requested
(a) When a wheelchair accessible vehicle is requested, First Class Travel Waco will provide a wheelchair accessible vehicle, or cause one to be provided, without unreasonable delay.
(b) Operating authorities and drivers are prohibited from charging a higher fare rate for wheelchair accessible transportation-for hire vehicles.
Tickets are limited as endorsed and are non-transferable. The unauthorized resale of First Class Travel Waco tickets is strictly prohibited and will be prosecuted. Tickets are valid ONLY for the schedule, date and time for which purchased. All passengers must be checked in with an attendant five minutes prior to departure. Customers who fail to cancel a trip at least two (2) hours prior to departure or who do not board the vehicle at least 5 minutes prior to departure will be considered a no show and all fare will be forfeited.
Safety Belts and Child passenger Safety Seats
By Texas Law - All passengers are required to wear safety belts during operation of the vehicle and a child who is younger than eight years of age, unless the child is taller than four feet, nine inches must be secured during the operation of the vehicle in a child passenger safety seat system according to the instructions of the manufacturer of the safety seat system. This safety seat system must be provided by the passenger. First Class Travel Waco will store the child passenger safety seat for an additional charge if required on round trip tickets. First Class Travel Waco reserves the right to refuse service without refund to any passenger that does not abide by the above conditions.
Fares & Fees
Fares are valid ONLY for the schedule, date and time for which quoted. Discount fares are subject to date, time and schedule restrictions. Fares may be subject to additional charges including taxes, fees and carrier price diﬀerences. Requests for exchanges must be made at least 2-hours prior to the original travel departure time; otherwise, the ticket will be null and void. All unrestricted one-way or roundtrip ticket fare that is cancelled with a First Class Travel Waco agent within 24 hours of the ﬁrst segment of the trip but 2-hours prior to the time of departure is available as First Class Travel Waco travel credit for six (6) months from the date of sale. Fares are payable in US dollars only unless stated otherwise. Fares are subject to change and may be higher during holiday and peak periods. More information on speciﬁc fare classes and restrictions can be found on the website.
Cancellations & Modifications
Tickets cancelled greater than 24 hours in advance of the ﬁrst leg of the departure time are fully refundable, at a value equal to the fare paid, to the original form of payment used to purchase the ticket.
Tickets cancelled inside of 24 hours and prior to 2 hours before the ﬁrst leg departure time of your trip are re-usable for future travel at a value equal to the original fare paid. Tickets cancelled less than 2 hours prior to the trip departure time are non-cancellable and nonrefundable except for cancellations due to verified flight cancellations or significant delays barring customer travel in the same day.
Credit for cancelled trips expires six months after the cancellation date and is removed from a passenger's account. There is no refundable or re-usable value for a "no-show" ticket. Trips booked within 24 hours of the departure time are not refundable to the purchaser's credit card.
All tickets may be modified to another scheduled trip provided there are seats available on the newly selected trip. Modifications may result in additional charges should the newly selected trip have a higher fare. All modiﬁcations must be made by a First Class Travel Waco representative. Cancelling your existing trip and purchasing a new ticket will result in a second charge to your credit card. Your cancelled trip will be subject to our cancellation policy and thus may result in a loss of fare or the issuance of First Class Travel Waco credit. Any modiﬁcation made less than two hours prior to the departure time of a trip results in a new ticket that is non-refundable.
Holiday and peak week tickets are subject to a 14 day cancellation policy and are non-cancellable/refundable within 72 hours of trip departure.
First Class Travel Waco Rewards
First Class Travel Waco may, in its discretion, change the First Class Travel Waco rewards program rules, regulations, and award level at any time with or without notice. This means that the accumulation of trip credit does not entitle members to any vested rights with respect to such mileage credits, awards or program benefits.
First Class Travel Waco may, among other things, (i) withdraw, limit, modify, or cancel any award grant; (ii) change program benefits, mileage levels, participant affiliations, conditions of participation, rules for earning, redeeming, retaining or forfeiting mileage credit, or rules for the use of travel awards; (iii) rename or redefine program elements or benefits; (iv) add travel embargo dates, limit the number of seats available for award travel (including, but not limited to, allocating no seats on certain trips) or otherwise restrict the continued availability of travel credit awards.
First Class Travel Waco may make any one or more of these changes at any time even though such changes may affect your ability to use the credit or miles that you have already accumulated.
First Class Travel Waco Rewards members must have trip earning or redeeming activity once every 6 months in order to retain their rewards. If your account has no qualifying activity in any 6-month period, all miles and credit in the account will expire. Qualifying activity extends the expiration date of all unexpired mileage credit in your account for 6 months from the date of the qualifying activity.
Departure dates and times may change. First Class Travel Waco is not responsible for delays caused by breakdowns, road conditions, weather or conditions beyond carrier's reasonable control.
First Class Travel Waco will not be responsible for missed flights at any airport that are a result of inclement weather, unforeseen road closures, highway construction, unusually heavy traffic, or any other conditions that are out of the control of First Class Travel Waco, not limited to but including equipment issues. We will make reasonable efforts to find alternative transportation in the event of an equipment issue and complete the trip.
Seating is not based on race, color, creed, national origin or any other protected characteristic. All travelers are required to check-in with a First Class Travel Waco representative 5 minutes prior to their scheduled departure.
All travelers must be prepared to present a government issued photo identification that matches the traveler's name on the First Class Travel Waco trip manifest.
First Class Travel Waco takes reasonable steps to ensure the safety of the parking lots provided for passengers, but First Class Travel Waco provides no warranties or guarantees regarding parking.
You are solely responsible for any damage to your vehicle or any property inside your vehicle during your trip. You should park in a well-lit area and lock your doors prior to boarding.
Passengers are limited to bags of 50 pounds or less and one carry-on bag that can fit in a vehicle's interior storage compartments. Please be advised that bags that commonly fit in a commercial airline overhead compartment may not fit in a motor vehicle's onboard compartment. Any bag that does not fit in a storage compartment will be required to be placed in the luggage bay which is not accessible during a trip. Any bag a traveler wishes to have with them during transit must fit in the storage compartment, which generally can accommodate a briefcase, computer bag, or backpack. First Class Travel Waco is not responsible for any damage done to a piece of luggage during transit.
All passengers, regardless of age, must have their own purchased seat. Lap children or infants are not allowed aboard any First Class Travel Waco trip. At the time of reservation, we request that you inform us as that you will provide child seats. We are REQUIRED BY LAW TO USE CHILD SEATS WHEN APPROPRIATE. If you have not informed us you need a child seat when you make the reservation, we cannot guarantee your ride unless you have brought your own child seats. We cannot transport a child that requires a child seat and does not have one. If you do not inform us of your need for a child seat(s) and you do not bring your own, the fare is NOT refundable. Children are not permitted to walk in the aisle during a trip and must remain seated. The First Class Travel Waco cabin is smaller and quieter than an aircraft.
Children age 10 and above may travel alone provided that an Unaccompanied Minor form is submitted to the First Class Travel Waco Passenger Service Center prior to the departure of the child's trip.
Small dogs and cats, weighing less than 10 pounds, in a carry-case that can fit by a passenger's legs, are allowed on a First Class Travel Waco vehicle. The carry-case must be fully enclosed and the pet fully secured in the case. The case is not permitted on any table, seat, or in the vehicle aisle. The case, with dog inside, must remain on the floor by the passenger's feet throughout the trip. The carry case must not impede the personal space of any other passenger, their seat, or leg rest. Other animals are not allowed aboard the motor vehicles.
Service animals that are "trained to take a specific action when needed to assist the person with a disability" are allowed aboard without being in an animal carrier. All service animals must be harnessed and controlled by the passenger at all times. First Class Travel Waco adheres to the Americans with Disabilities Act (ADA). The ADA does not cover emotional support dogs. Therefore, emotional support dogs that cannot adhere to the pet policy above cannot travel aboard First Class Travel Waco. First Class Travel Waco reserves the right to charge a fee for excessive damage to our vehicles or fleet caused by any guest or guests. For excessive cleaning, a minimum of $250.00 will be charged to the guest. For excessive damage to the interior or exterior of the vehicle caused by a guest, including but not limited to the body of the vehicle, leather seats, windows, DVD players, sunroofs and any and all mechanics or amenities on board, First Class Travel Waco reserves the right to charge any guest or guests the amount to correct, repair or replace any said damage.
Bicycles cannot be stored in First Class Travel Waco luggage bays. Due to the unique nature of our motor vehicles we do not have the same luggage capacity.
Smoking and Smokeless Tobacco
Smoking including the use of electronic simulated smoking materials, e-cigarettes, and smokeless cigarettes, is prohibited in our vehicles. Smokeless tobacco products are not permitted in First Class Travel Waco vehicles.
Lost & Found
First Class Travel Waco will make every eﬀort to locate an item reported as left on a motor vehicle and return that item to the owner. Any food or other perishable items left on the vehicle will be discarded. Once an item is found, owners must provide a pre-paid shipping label to First Class Travel Waco in order to receive the item. Unclaimed items and items not retrieved via a pre-paid shipping label provided by the owner will be salvaged after 30 days.
Travelers are expected to exhibit professional courtesy and behavior onboard First Class Travel Waco motor vehicles. First Class Travel Waco follows a "library voice" policy during all trips. Phone calls and conversation must not disrupt the experience of other travelers and must be kept at a low volume level. Audio playback on personal electronic devices is not permitted without headphones. All devices including cell phones must be placed on silent or vibrate for the duration of the trip. All crew member instructions must be followed during boarding and transit. First Class Travel Waco reserves the right to remove any passenger who, in First Class Travel Waco's sole opinion, is exhibiting behavior unacceptable to First Class Travel Waco travel or who fails to follow crew member instructions. Examples of unacceptable behavior include, but are not limited to, intoxication, using illegal or prohibited substances, rowdy, loud, lewd, offensive, or pernicious acts.
Limitation of Liability
First Class Travel Waco is responsible only for transportation on its own lines in accordance with applicable tariffs and limitations and assumes no responsibility for acts or omissions of others, including interline partners, hotel partners, or parking lot partners, except as imposed by law. In no event shall carrier be liable for consequential or incidental damages for loss, damage or delay, including weather delays.
